Terms of Use
Effective date: 2026-10-07
These terms govern your use of the Sweet Learners app and sweetlearners.com, provided by Massive Ventures, Inc. ("we"). By installing or using the app you agree to them.
1. Licence
The app is licensed, not sold, to you under Apple's Licensed Application End User License Agreement (the standard EULA), which is incorporated here. Where these terms add to the standard EULA, these terms apply in addition; where they conflict, the standard EULA prevails for matters it covers. Apple is a third-party beneficiary and may enforce the licence against you.
2. Who the app is for
Sweet Learners is made for children aged about 1½ to 4 and is intended to be used by a child together with, or under the supervision of, a parent or guardian. The parent or guardian who installs the app accepts these terms on the child's behalf. Purchases, links out of the app and account-level settings sit behind a parent gate intended for adults; please do not share the answer with your child.
3. What the app does
The app contains two games: Point and Say (tap a picture to hear its name) and Trivia (find the picture that matches a spoken question). Pictures and recordings are bundled with the app so it works offline. The app has no accounts, no advertising and no chat or messaging.
4. What the app does not guarantee
- The app is a plaything and a conversation starter, not a curriculum. We make no promise about what any child will learn, how fast, or about any developmental outcome.
- Pictures are illustrations and photographs chosen for clarity; they are not a complete or authoritative picture dictionary and may differ from the objects your child knows.
- Spoken names use standard English pronunciation and may differ from your family's words for the same things.
5. Content and personal use
The pictures, recordings, text, software and design in the app and on sweetlearners.com belong to us or our licensors and are for your family's personal, non-commercial use. You may not copy, extract, redistribute, sell or use them in another product, or use them to train or build a machine-learning model, without our written permission. You may share screenshots and videos of your child playing in the ordinary way people share such things.
6. Acceptable use
Use the app only on devices you own or are authorised to manage. You may not reverse engineer the app except where the law allows, remove any notices, or use the app or this website in any way that breaks the law.
7. Premium subscriptions
The free version of the app is fully usable and stays free. Premium is an auto-renewing subscription, billed by Apple, that unlocks additional categories and the parent view. The current prices and periods are shown in the app before you subscribe.
Payment will be charged to your Apple Account at confirmation of purchase or, if you start a free trial, when the trial ends. The subscription automatically renews for the same period at the same price unless it is cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel your subscription in Settings › Apple Account › Subscriptions, or from the parent area in the app; cancelling stops the next renewal and you keep Premium until the end of the period you have paid for. Any unused portion of a free trial is forfeited when you buy a subscription.
Refunds are decided by Apple under its App Store terms; request one at reportaproblem.apple.com. We may change Premium prices for future periods; Apple will notify you and ask for your consent where required.
8. Changes to the app
We may update, change or discontinue games, pictures or the app itself. If a change materially reduces what Premium includes during a paid period, contact us and we will put it right.
9. Disclaimer and limitation of liability
The app and this website are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, any educational or developmental result, or uninterrupted operation. To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for any loss of data, revenue or profits, arising from your use of the app. Our total liability for any claim relating to the app is limited to the amount you paid us for Premium in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law, including consumer rights in your country of residence.
10. Termination
You can stop using the app at any time by deleting it; this removes all play history and settings from the device. We may suspend or end your access if you break these terms. Sections 5, 9 and 11 survive termination.
11. Governing law
These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules, and any dispute will be brought in the state or federal courts located in Alameda County, California, except that consumers in the EU, UK and other jurisdictions keep the protection of the mandatory laws and courts of their country of residence.
